The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) and the General Data Protection Regulation (“GDPR”) require us to inform parents and legal guardians (as used in this policy “Parents”) about our practices for collecting, using, and disclosing Personal Information from children under the age of 13 and 16 respectively. For purposes of this UltiMaker Children’s Privacy Policy, the terms (“Child” or “Children”) shall refer to persons under the age of 16. COPPA and GDPR also require us to obtain verifiable consent from Parents if there is any collection, use, or disclosure of a Child’s Personal Information. UltiMaker applies these protections uniformly to all users under the age of 16, regardless of their location.
This UltiMaker Children’s Privacy Policy supplements the UltiMaker Privacy Policy and the UltiMaker Account Terms and Conditions to which this UltiMaker Children’s Privacy Policy is incorporated. Capitalized terms used herein that are undefined shall have the same meanings ascribed to them in the UltiMaker Privacy Policy or the UltiMaker Terms of Use.
Children who create an UltiMaker Account in accordance with the terms described herein (“Child Users”) must provide us with the following Personal Information to register an UltiMaker Account with our Sites: first name, last name, email, country, username for Sites, birthdate, and password for Sites. If verifiable parental consent is not received by UltiMaker from you, we will delete the Personal Information your Child provided to us during the UltiMaker Account registration process and an UltiMaker Account will not be created for your Child.
We use technology to automatically collect information from our Users, including Child Users, and Children when they access and navigate through the Sites and use certain of the Sites’ features. The information we collect through these technologies may include:
One or more persistent identifiers and/or cookies that can be used to recognize a User over time and across different websites and online Sites; and/or Information that identifies a device’s location (geolocation information). We also may combine non-personal information we collect through these technologies with Personal Information about Users, including Child Users, that we collect online.
For information about our automatic information collection practices, including how Users and Parents, on behalf of Child Users, can opt out of certain information collection, please review the UltiMaker Privacy Policy.
We use the Personal Information we collect from a Child to register his or her UltiMaker Account.
We use and, in some cases, disclose the Personal Information we collect from a Child User to:
communicate with him or her about activities or features of the Sites that may be of interest; estimate our audience size and usage patterns; store information about a Child User’s preferences, allowing us to customize the content according to individual interests; speed up a Child User’s searches on the Site; share with third parties we use to support the internal operations of our Sites and who are bound by contractual or other obligations to use the Personal Information only for such purpose and to keep the Personal Information confidential; comply with law or legal process, such as to comply with any court order or subpoena or to respond to any government or regulatory request; protect the rights, property, or safety of UltiMaker, our customers or others, including to protect the safety of a Child User; protect the safety and security of the Sites; and/or enable us to take precautions against liability. We do not share, sell, rent, or transfer a Child’s or Child User’s Personal Information other than as described in this section and the UltiMaker Privacy Policy.
We do not condition a Child’s participation in any activity on the disclosure of more personal information than is reasonably necessary.
A Child may not register an UltiMaker Account for use of the Sites or Services without UltiMaker’s receipt of verifiable consent from the Child’s Parent. Children may only register an UltiMaker Account for use of the Sites or Services if UltiMaker has received verifiable consent from the Parent of the Child seeking to create an UltiMaker Account. Additional information regarding verifiable parental consent is available below.
UltiMaker has the right to seek direct or third-party verification of any UltiMaker Account created on behalf of a Child and reserves the right to take legal action against any User of the Sites and Sites who creates an UltiMaker Account on behalf of a Child without the proper authorization required under this UltiMaker Children’s Privacy Policy, COPPA, and/or GDPR.
While our Sites and Sites are broadly available and not marketed exclusively for educational use, we recognize that some U.S. educational institutions may choose to use them in connection with students. When used in an educational context, UltiMaker may collect, process, and maintain Student Data on behalf of and as authorized by the educational institution or Parent, in compliance with the Family Educational Rights and Privacy Act (“FERPA”). “Student Data” means information directly related to a student maintained by an educational institution or by UltiMaker on its behalf, including education records as defined by FERPA.
UltiMaker acts as a “school official” under FERPA and only uses student education records to provide the contracted Sites and for no other purpose. We do not sell or use Student Data for advertising or marketing. Any Student Data collected is subject to the same protections and rights described in this UltiMaker Children’s Privacy Policy and the broader UltiMaker Privacy Policy.
To support compliance with FERPA and applicable state privacy laws, UltiMaker will review any Data Processing Agreement (“DPA”) requested by an educational institution. These agreements govern the collection, use, disclosure, and retention of Student Data. If executed, the terms of the DPA will take precedence over this Privacy Policy in the event of any conflict.
Schools or Parents acting on behalf of their Child may request review or deletion of a student’s Personal Information by contacting us at [email protected].
Part of our UltiMaker Account registration process requires a Child to provide a Parent’s email address. UltiMaker will send instructions via email, which include the required “Parental Consent to the Collection, Use and Disclosure of Personal Information of My Child to UltiMaker” form. Verifiable parental consent is obtained exclusively through completion and electronic signing of this form.
If verifiable parental consent is not received within a reasonable period, the Personal Information provided by the Child during registration will be deleted. We retain Personal Information collected from a Child only as long as necessary to fulfill the stated purpose.
For questions regarding verifiable parental consent for the registration of an UltiMaker Account for your Child, please contact [email protected] or [email protected]. At any time, you may review your Child User’s Personal Information maintained by us, require us to correct or delete the Personal Information, and/or refuse to permit us from further collecting or using the Child User’s Personal Information.
You can review, change, or delete your Child User’s Personal Information by sending us an email at [email protected]. To protect your privacy and security, we may require you to take certain steps or provide additional information to verify your identity before we provide any information or make corrections.
Please direct all questions and comments regarding this UltiMaker Children’s Privacy Policy or our privacy practices in general, to [email protected].
We may update this UltiMaker Children’s Privacy Policy from time to time. If we make material changes, we will provide notice via email or on our Sites, and update the “Last Updated” date at the top of this policy.
